Supreme Court Declines Early ACA Review

The U.S. Supreme Court has refused to let a Patient Protection and Affordable Care Act (PPACA) constitutionality case jump the line National Underwriter.

The court has issued an order in connection with the case, Cuccinelli vs. Sebelius (10-1014), stating that, "The petition for a writ of certiorari before judgment is denied."

The suit, filed by Virginia Attorney General Kenneth Cuccinelli II in the U.S. District Court in Richmond, Va., is an effort to have the courts declare that PPACA Section 1501 - the "minimum essential coverage provision" - is unconstitutional.

Section 1501 would require many people who have incomes over a minimum level to have a minimum level of health coverage accessed through the Health Insurance Exchanges or else pay a penalty.

The earliest that the case will be reviewed by the Supreme Court now is in October.
